For legal purposes, the term “drug” refers to a controlled substance. Controlled substances are drugs or chemicals that the federal government deems potentially dangerous because of their potential to be abused or to lead to addiction. Substances are classified, or “scheduled,” based on their potential danger and whether or not they have any widely accepted, safe, legitimate uses. The most dangerous substances are Schedule I, and the least concerning are Schedule V.
Although drugs are classified at the federal level, each state has its own unique laws concerning controlled substances. Drug abuse is a major public safety and public health issue across the country, and Alabama is no exception. In 2024, over 17,800 drug-related arrests were reported in our state. Incidentally, Alabama has some of the most stringent drug laws in the country.
Drug crimes are generally split into four categories. They are:
In Alabama, possession of any amount of a controlled substance, with the exception of prescription medications prescribed to you, is a felony. There are also some exceptions to this for marijuana up to certain amounts.
Simply having a controlled substance constitutes drug possession, but being in possession of a larger amount of a substance can imply that the drugs were not just for personal use, which can upgrade a charge to possession with intent to distribute. Actually selling or passing drugs to someone else constitutes distribution.
Drug trafficking involves moving drugs on a larger scale, either for yourself or on behalf of someone else, with the end goal of distributing them. Finally, manufacturing charges cover offenses like making methamphetamine.
As previously mentioned, Alabama has some of the strictest drug laws in the country and also some of the harshest punishments. Simple possession of a controlled substance is an automatic Class D felony, according to Alabama Criminal Code 13A-12-212. Possession with intent to distribute, actual distribution, trafficking, and manufacturing are all more serious offenses, resulting in higher-class felonies.
Sentences for felonies are governed by Alabama Criminal Code 13A-5-6. The minimum jail term for a Class D felony is one year and one day. Most Class A felonies carry sentences of life imprisonment, but the absolute minimum jail sentence for a Class A felony in Alabama is ten years. Repeated offenses can compound and result in more severe charges and longer prison terms.
Aside from a felony on your criminal record, drug-related convictions can result in long-term, life-altering consequences. The financial burden can be severe, as many felony convictions also come with hefty fines. Furthermore, people convicted of felonies often have trouble finding secure employment or even housing later in life. There can also be significant social consequences. Unfortunately, one mistake can have lasting effects.
The first thing anyone facing drug charges should do is hire a drug crime lawyer. An experienced attorney who is well-versed in drug crime laws can sometimes be the difference between a conviction and a dismissal. Your attorney can help you understand your legal position, study every detail of your case, and make sure due process is followed.
When it’s time to go to court, your lawyer can represent you and help you present your case to the judge. While it is true that you can represent yourself, you can be more likely to see a favorable outcome if you have the help of an attorney.
According to the most recent data, fentanyl and other opioids are the greatest drug-related threat to public health and public safety in Alabama. Published by the Alabama state government, this data comes from reports from law enforcement officers and drug treatment facilities. In Jefferson County alone, fentanyl overdose cases increased by 22% in just one year.
First-degree manufacture of a controlled substance is a Class A felony in Alabama. This is the most serious felony category, and the minimum prison term is 10 years. Depending on the substance, whether there was intent to distribute, and the quantities involved, a court may decide to impose a more severe sentence. Your lawyer can help you understand the particulars of your situation.
The distinction between distribution and trafficking is made based on the amounts of controlled substances in question. For example, the minimum amount of marijuana that must be involved in order to pursue trafficking charges against someone is 2.2 pounds. Any amount less than that is more indicative of simple possession or possession with intent to distribute.
If you are prescribed a controlled substance as a medication, such as an opioid pain reliever, it is, of course, lawful for you to have your medication. However, it is not lawful for you to give that medication, even one pill, to anyone else. You could be charged with the distribution of a controlled substance, which carries severe penalties.
