Understanding DUI Charges

In Alabama, a DUI charge means you are in physical control of a vehicle and any of the following is true:

  1. Your blood alcohol content (BAC) is 0.08% or more.
  2. You are influenced by alcohol.
  3. You are influenced by a controlled substance to the extent that you are unable to drive safely.
  4. You are influenced by a combination of alcohol and a controlled substance to the extent that you cannot drive safely.
  5. You are under the influence of any substance that impacts your mental or physical capabilities and prevents you from driving safely.

You may have been driving with a BAC under the legal limit, but if there is evidence that you were under the influence and it affected your driving, yocan still be charged with a DUI. No matter the circumstances of your DUI, effective legal defense is essential to securing the ideal outcome.

When a crash is involved in a DUI offense, the penalties can be much more severe.

Penalties for a DUI in Baldwin County

If you are convicted of a DUI, the penalties are more severe if there are aggravating factors. One of these factors includes whether you have prior DUI convictions. Other aggravating factors include:

  • Refusing to provide a BAC sample
  • Having a child under the age of 14 in the vehicle
  • Someone other than you was injured in the offense
  • Your BAC is 0.15% or higher

For a first offense of a DUI, you could face the following penalties:

  • Up to one year in county or municipal jail
  • A fine of between $600 and $2,100
  • Suspension of your driver’s license for 90 days

The suspension of your license can be prevented by having an ignition interlock device (IID) installed in your vehicle for 90 days. If, on a first offenseany other aggravating factors are present, then your license will be suspended for 90 days, and you will be required to have an IID installed for one year after your driving privileges are reinstated.

For a second DUI offense within ten years, the penalties could include:

  • Imprisonment for up to one year, with the potential for hard labor
  • A minimum of five days in jail or 30 days of community service
  • Fines between $1,100 and $5,100
  • Revocation of your driver’s license for one year
  • Required installation of an IID for two years after driving privileges are reinstated

On a third DUI conviction within ten years, you could face penalties like:

  • Between 60 days and one year in jail
  • 60 days of mandatory imprisonment
  • Fines between $2,100 and $10,100
  • Revocation of your driver’s license for three years
  • Required installation of an IID for three years after the reinstatement of your driving privileges

A fourth or subsequent conviction within ten years, or if one of the prior DUIs was a felony, it is charged as a Class C felony, and penalties include:

  • Imprisonment for between one year and one day and 10 years, potentially with hard labor
  • Fines between $4,100 and $10,100
  • Revocation of your driver’s license for five years
  • Required installation of an IID for four years after privileges are reinstated

The existence of aggravating factors in a second or subsequent offense significantly worsens the potential penalties you can face.
